We will review the lease obligations covering repair, decoration and reinstatement, carry out comprehensive inspections and preparation of Scott schedules of dilapidations as well as photographic condition surveys, to provide advice on lease end obligations for both landlords and tenants. WHAT ARE Scott schedules?
Dilapidation schedules can cover the position during the lease, at lease end or after the lease has expired. The recognized reporting format is often referred to as a Scott schedule which sets out the breaches item by item in a table format and provides a running commentary between the parties on what is in dispute and negotiations. In addition, the costs of the works and associated cost/loss claims are prepared under a Quantified Demand.
Quantified DEMAND AND S18 VALUATIONS
A Quantified Demand sets out the landlords claim against the tenant in monetary terms covering both the cost of works along with other aspects including fees and rent. These claims need to be considered in the context of the loss to the landlord which can be governed by what is called a Section 18 valuation, which can then be compared against the Quantified Demand to ensure any proposal is reasonable.
